Court Overturns Key Element of Trump’s Trade War

A key element of Donald Trump’s trade war has been overturned by a U.S. appeals court, which ruled that his use of a national security law to impose global tariffs was illegal. This decision strikes at the heart of his administration’s unconventional and aggressive trade tactics.

The court’s 7-4 decision centered on the International Emergency Economic Powers Act (IEEPA), which Trump invoked by declaring the U.S. trade deficit a national emergency. The judges found this to be a misuse of the 1977 law, stating it was not intended to give presidents the power to bypass Congress and set their own tariff schedules.

The ruling throws into chaos the numerous trade understandings Trump negotiated. These deals were often accepted by other nations as the lesser of two evils compared to the tariffs. Now that the tariffs have been ruled illegal, the rationale for these deals has evaporated.

The former president has pledged an appeal, escalating the conflict to the Supreme Court. The case will be a landmark test of executive authority, forcing the nation’s highest court to draw a clearer line between a president’s emergency powers and the constitutional authority of Congress to regulate commerce.
